: and the nearest place of that kind happens
to be beyond the sea or out of the dominions of the
state: or as if a man being in continual apprehension
of sustaining at the hand of another some very heavy
injury [whether it be respecting his person, property, reputation,or
matrimonial condition,] should fancy that he had no
other means than that in question of securing himself
against the enterprises of his adversary: In all such cases
the innocence of the intention may form some sort of a ground of
excuses however, light an one, of extenuation.

will be proper to settle whether this right shall be included
