Of Injuries affecting loco-motion
Of Kidnapping. Confinement
Extra-punishment
Where this and the preceding aggravation concur,
imprisonment, banishment or penal labour
for a time not less than [twice] as long as the
time that continuance of offence. This at all events.
Exposition
[(a) Continuance] The offence is to be deemed to have
continuance until the party injured has been
convey'd back at his option, either [at the expence of the offender] to the
place to the place from whence he came or
was convey'd, or if that be the place at which he
wishes to be; if not, to any other place at
which he wishes to be; so it be a place to
which he could have gone had it not been for
the offence to his own home: or to any or if he
like rather, and the offender also consent, to any
other place. And the expence of such conveyance
shall be born by the offender, as far as he has wherewithal.
Observations
It may here occur, that the remedy as above
prescribed, may in some cases be incompleat. For
the it may happen that the party injured, being
at a place not his house, was in contention
or upon a certain event that afterwards happend
would have been in the intention of going
to another place: and then came the offenders, and carried
