24 Of Injuries to the C liberty of loco-motion.
Of Kidnapping Confinement
The safest course therefore seems to be to
fall with equal force upon the party injured:
For the offender, not being able to give him compleat
redress, and not finding his account in
giving him any other will give him none at
all. It will be with him just as it is with insolvent
debtors, who as they can not clear themselves
by paying any thing else less than all, will not
pay a farthing. + + See Tit. [Of Insolvency]
The most eligible course therefore to take
seems to be that presented in the text. The
inconvenience which the party injured suffers by
being prevented from going to the place he intended
to go to may afterwards like any other
consequential mischiefs meet with a separate
provision as well in the way of compensation
as of punishment. To the next par. but one
Instructions to the Judge

banishment is long and the hardships various various let the Judge be careful
that as much as in him lies that no part of

From par. 2. It is obvious enough that the nature of this
offence is liable to be modified by local circumstances. The law relative to it will therefore need to wear an
aspect some what different according to the local &
other characteristic peculiar circumstances of the state or district.
