Of Confinement
-fined from maintaining the course of conduct in
question being a positive one, and that voluntary,
such act becomes a positive offence: an it be comes under the positive
offence species of the genus of offence in question. It is
only one mode amongst others of committing
that the positive species of that offence. The injurious
act therefore in this case includes two different
species of offences injuries of which so many different
persons are the objects: the offence whatever
it may be of which the third person is the object:
and the act of unlawful confinement, of by which the party confined
is the object person grieved. Thus in the case
of a simple personal injury: a surgeon is detained held
in confinement to prevent his going giving relief
to a person who has received a wound. This is
an act of confinement with respect to the Surgeon,
and act of according to the event a simple personal injury
an irreparable person injury or an act of homicide
with respect to the wounded person wounded.
A mother is confined to prevent her suckling her
new-born infant: this according to the event is at any rate
in an act of confinement with respect to the
mother, and according to the event an act a simple
personal injury or an act of homicide with respect
to the child. A husband is held in confinement
to prevent his going to the assistance of his
wife whom a ravisher is assaulting: this is an act
