Of Confinement
act of confinement with respect to the husband,
and an act of complicity with regard to rape as
against the wife.
In the same manner = so in the other two it may be understood
how an act of confinement when thus
directed may be an act co incident come to co-incide with any
offence of the number of those which are either
to the prejudice of a subordinate class
of persons or of the state. In this case it takes being taking the form of a principal
offence, if there be no other person whose position intentional
and advised agency is necessary to the production
of the mischief; or of an act of complicity, if
there be any such other person: but at any
rate always including that particular species of private injury which is termed an act of unlawful confinement
with respect to the party so confined.
As obvious a case as any of those in which a
mischief is liable to be done in this way to the
state is that of an offence of against justice:
and of offences against justice as common
a case as any is that in which the purpose
of the confinement is to prevent the party
confined from appearing as a witness. In
such case it may be of use to observed on this occasion
as well as upon others that the mischief may
either be to the state alone, or to the state &
moreover to the some other party: to the state alone
