Of Confinement Reasons
2. On account of it's affording a stronger proof
of depravity of disposition than the other: + + See Introd. Ch. [Of Proportion &c] the mischief of being
the work of sudden passion in the latter case,
and of cool reflection deliberation in the former. It is to be observed that a simple personal injury although aggravated by the circumstance of premeditation, is but a work of sudden passion in comparison of the same injury inflicted during the a course of confinement of which the same offender is the author. See Introd. Ch Of Disposition par. 38 39. For at the first moment the degree of anger whatever it may have been the degree of anger which prompted It is to be the offender to meditate the offence, the old sight of his antagonist will naturally commonly in a man of the best nature exasperated for the first woman by the sight of his antagonist: but when he has had his antagonist for a considerable time together in his power, especially if he have already in any way given vent to his resentment, it is a sign of a disposition more than ordinarily depraved, if compassion (which is but another word for good will when directed towards an object under affliction) does not step in and plead with effect against any further outrage
