Of Semi-public Offences in General.

become the object. fall a sacrifice. But the extent as well as magnitude and extent of the damage
that may be done in certain circumstances by the tremendous instruments
in question is of so extraordinary a nature as to remove
these cases out of the class of private offences into that
of semi-public ones and as the treatment which they demand
in the way of punishment is different, so must the description
respectively given of them be such as may serve effectually to
distinguish the extraordinary from the ordinary offence.

Other Offences against a Neighbourhood how distinguished. Offences against a Neighbourhood that are not first rate crimes
may be distinguished, 1. Into Offences against the common property of
the Neighbourhood, and 2. Offences tending to expose the persons
or properties of the neighbours to calamities.

Offences against the common property of the Neighbourhood are in the main upon a footing with Offences against the property of Individuals. Offences of the first mentioned description are mentioned here
only for conformity, since they contain nothing that can distinguish
them from Offences against the property of individuals. If accompanied
with criminal consciousness and intentionality they will be punished criminally
in the same manner as if damage were done in the
same way and to the same amount by to an individual: if not
accompanied with criminal consciousness those circumstances they will be punishable
civilly only and in the way of compensation. In this case
so much of the compensation as regards the direct damage will go to
