Of Semi-public Offences in general
Punishment
Punishment as applied to Offences of mere delinquency. With respect to punishment, such offences of a semi-public
nature as are offences of mere delinquency will not need to be treated on a
footing very different from that of the several private offences
to which they respectively correspond. They
do not seem to require new mode of punishment
in addition to the ordinary one. But with respect
to quantity, as that of the mischief they may produce
is indeterminate, so ought also the punishment
to be: otherwise it may not be sufficient in
all cases to outweigh the profit of the offences. + + See Introd. the [Proportion &c]
The circumstance therefore which raises them respectively to the
rank of semi-public offences, may be consider'd as
a circumstance of aggravation, but not attended
with any extra-punishment. This however is to be understood
with exception to the three great offences above mentioned: Incendiarism, Inundation and Shipwrecking. The extraordinary mischievousness and of these offences makes it advisable (as we shall see presently) to annex to each of them an many extra-ordinary and severe punishment, heavier that any which seems is requisite for any crimes.
Nor is the increase of the which the circumstance
in question gives rise to in point of punishment
the only circumstance which makes it proper to
distinguish these from private offences: other, distinctions
will be found necessary to be made respecting
them in the business of Procedure. + +
