Of Destruction or Endamagement

Where the destruction or endamagement offence has the
effect of Theft: by making when the nature of
the thing destroy'd or damaged being such that
from the destruction or endamagement of it
a profit or indemnity results to the destroyer or some one
whose interest he espouses.
Extra-punishment
2 As for theft to the amount of the loss, produced
or the profit (A) or indemnity B. made by the offence, which ever
be the greater: and this without the benefit of having
the hard labour commuted into Imprisonment. To p. 6. par. 2.

Exposition
[(A) Endamagement] Destruction and Endamagement may be used for one another. Destruction
is endamagement carried to the utmost;
Endamagement is partial destruction.
II
Destruction or Endamagement when culpable how punished. Destruction when unlawful is either simply
culpable, obstinate or criminal. It is simply culpable, when
committed through heedlessness (A) or rashness (B): Criminal and
also in any in when committed negatively: as also in any other case in which it is not obstinate or clandestine. In these criminal these
destruction is either vindictive, , or
cases it may be punished by fine not exceeding the
value of the damage.
