Of criminal Inundation

Criminal Inundation is where without
lawful cause (A) a man is concerned (B) in laying
a country under water; intending (C) thereby to
endanger the life or damage the property of
another to the amount of [L.S. 100 (D)] having no
right so to do, and knowing that he hath none.

[(A) Lawful cause] Justifications.
Are the same as in Incendiarism.
[(B) Concerned] See Tit. [Of Associates in Delinquency Co-offenders.]
[(C) Intending] It matters not whether the Intention
be direct or indirect.
[(D) L S 100] If it be short of that amount it is
only criminal devastation. destruction. See Incendiarism.

For criminal Inundation the offender's
punishment shall be as follows

1. He shall be punished with the water
torture once or oftner and for a longer or a shorter
time according to the quantity of the damage.
By water was his crime: he offended; by water he shall be
tormented his punishment.
