Of Sharping or Fraudulent Obtainment. Of Defraudment

[(D) Obtaining] 2. It matters not whether the thing obtained
were in being at the time that the contrivance
for obtaining it began to be employed or
whether part of the contrivance was to cause it
or a part of it to be brought into existence: as
if a man prevail on you to make or execute
a deed to your prejudice.
3. It matters not whether the thing when obtained
be were delivered to the offender himself or
not; whether it come into his custody or not;
as if a man having prevailed on You to execute
a deed to the prejudice of your natural heirs,
a Will for example, leaves it in your custody,
or gets You to deposit it with a third person. To p. 4.
4. It matters not whether it were only the actual a temporary right possession only of of possessing the thing that was obtained or the temporary right of possessing it (which in such case ceases of course upon the discovery of the fraud) or both together. In the first case it is an aggravated case of wrongful occupation; in the second of wrongful usurpation. [(E) Money's worth] Or a thing that has a Value
