Defraudment by wagering.
usages the established in that behalf, is understood
to subject himself to forfeit the stake in question,
upon such and such contingencies.
Let the stake, for instance, depend upon
the cost of a die. One fact which is presumed
and tacitly agreed upon between two persons who play with dice, is
that neither party shall use or has used any
art to make the dice turn up in one way
rather than in another. If then any such art
be employ'd, the not discovering it, but demanding
or receiving the stake which by the terms
of the implied agreement was to be paid only
in case the dice turned up in the way in
question without the using any such art to
cause them so to do, or the behaving in any
other way as if no such arts were employ'd
is a tacit way of suggesting that they were
not employ'd.
