exposed to public ignominy in the same manner as
the vilest malefactors might occasion such a measure
of distress and discontent as well among the his particular friends and
relations of the offender as among persons of the like
rank & condition as might better perhaps be spared.
It is to be observed that the proof of
All this is out of the question with regard to cheating
by false implements; which degrades a man beyond
dispute to a level with professed sharpers.
3. It is to be observed that when false implements
are out of the question, the guilt of the offen defendant
may be matter of great uncertainty: insomuch that
an innocent man is more in danger of being
convicted of this offence than of most others.
4. The mischief of the offence is not such as to
demand an inflexible degree of severity. Society
could not subsist without buying and selling: and therefore
fidelity in those transactions must by all means
be provided for. But society may might very well subsist
without gaming. It must be admitted however on
the other hand, that while those transactions are
both carried on, whether a man is defrauded of a
given sum the one way or the other, the mischief
is much the same.
