Simple Mercantile Defraudment
1 Simple mercantile defraudment (A) is where a
fraud is committed in buying, selling, lett hiring
or letting (B). It may respect goods + + or things, or commodities, or valuables (C) goods commodities or labour and in workmanship:
labour: (D) and in regard to either it may concern quantity or quality:
it may also concern the time or place of the delivery of the goods or the performance
of the labour, if those circumstances
happen to be material in point of in the with regard to the value of such
goods or labour.
Exposition

defraudment in general is the not intending to be

a modification of that of buying and selling: hiring
and letting are but buying and selling the use of a
thing for a time: as buying and selling in the
common acceptation of those terms are but the buying
and selling the use (to which is added in most cases the power of disposing
of it) for ever.
[(C) Goods] By goods on the present occasion are
meant any sort of things that are susceptible
of a a value: whether moveable or immoveable
