Of Simple Mercantile Defraudment
Instructions to the Judge.
Indications of fraud. Frauds mercantile. [(A) Defraudment] See Tit. [Defraudment.] The fraud in this case will depend principally
upon to the vendor's the dealer's knowledge of the circumstance
which renders the thing inferior in point of quality value,
to what it is sold for he puts it off for, this is a point which in general it
will not be easy to prove by positive testimony. There are
several circumstances however which singly or jointly
may afford such presumptive proof as may be sufficient
to warrant a conviction. These are for instance [1.st The
obviousness of the defect to any one who keeps it for a
long time in his possession
2. His selling frequently things of a similar low value
at a similar high price.
3. His keeping none but such debased or counterfeit goods
in his possession.
