15. C Of Simple Mercantile Defraudment

With respect to Responsible Persons the Punishment of accounting may serve instead With regard to Offenders who are in responsible circumstances
the punishment of being made to account for
their whole wealth seems a proper succedaneum to corporal
and ignominious punishment. This punishment
will be by no means a slight one; it may perhaps
by many be thought too severe. The judge therefore
ought not to be bound to apply it in all cases; he
ought to be empowered only to apply it in such cases
as he thinks proper. It is particularly calculated to
bring the punishment to a conformity with the third Explanation
of the first rule of proportion: to the end that no man after
having amassed a fortune by a long course of iniquity,
and having been once detected may after the Law has done
with him find himself a gainer upon the whole. To p.9. at top
