Of Simple Mercantile FDefraudsment.
Upon an application <add>oath made by any person of his having commission of a mercantile fraud, let the Judge, if he think proper grant a warrant</add> or searching the shop or warehouse to know whether there
be any more such adulterate or damaged Wares; if there
be (whether of the kind in question or any other,) let the whole
quantity be either confiscated or destroyed as there is
occasion: and let the dealer suffer as for those articles
which he has sold. The Judge should have power to
examine all persons upon the spot.
Provisions against oppressive proceeding. But to guard against partialities, there should
either be at least two Judges, or if there be but one he
should be accompanied by some indifferent persons in
the capacity of Assessors; or the Master of the Shop might
have it in his power of calling to call in any one or two persons
whom he should happen to see passing by, and
who should be present, if he thought proper, during the
whole time of the search and examination.
Provision for an Appeal. In this case either the Judge or Judges should have
power to make a record of the whole matter upon the spot or
