Frauds relative to the Coin.
[(D) Counterfeiting] Counterfeiting is the fashioning any substance
which is not genuine (AA) and undiminished Coin in the
intent of causing it to pass for genuine and undiminished.
[(AA) Genuine] The word genuine is to be understood here
with reference to that denomination of Coin for which the
piece in question is intended to be passed. Accordingly if
in counterfeiting a piece of genuine Coin of a given Value
a man employ a piece of Coin of an inferior Value it is counterfeiting
the former as well as if he had taken any other
portion of matter which had never been in the shape of
any kind of Coin. For instance if a man takes a piece
of Copper coin and washes it or rubs it with mercury
or cases it with Silver to make it look like Silver: or
beats out a smaller piece of silver Coin to the diameter of
one of a larger kind.
Genuine Coin, what [(E) Genuine Coin] Genuine Coin is that which, in the state
of which it purports to be the Coin, is made at the public
Mint, by persons employed by publick Authority, proceeding according
