Of Frauds relative to the Coin. Reasons
carried on to a certain length without suspicion; owing to the
difficulty of discriminating those who know of the sophistication
from those who do not, and the indemnity which it is
necessary to establish in favour of persons of the latter description.
II. 2. Because a single act is conclusively presumptive of a habit. Because in the Case of Frauds upon the Coin a single
Act is more surely presumptive of a habit, than in most other
Cases of Fraud: and in general than in most other offences against Property. + + See Explanation 3d. of the 1st. Rule of Proportion between Punishments & Offences.
When a man betakes himself to Coining he sits down to
it as to a regular occupation. He lays in a stock of Utensils and materials;
the expence of which if it were not for his following
the occupation for a continuance, must commonly much
more than eat up all the profits; a circumstance which is as
good a proof as any which the nature of the things can afford
of a man's intending to continue in the practice of this kind
of Fraud, for an indefinite length of time. On the other hand
if a man is not himself the Coiner, nor concerned with any
one who is, the uttering the base Coin is an Offence that can only
