Of Culpable Insolvency.
Punishment for Insolvency through Indolence. For Insolvency through Indolence the Offender might be made
to wear for a certain time a coat of a particular appearance called
the Idler's Coat.
For Insolvency through Incapacity, no Punishment. For Insolvency through Incapacity there should be no punishment. The misfortune added to the disgrace of the senctence
is a sufficient punishment.
Punishment for Insolvency through Rashness ex-post-facto. For Insolvency through Rashness ex-post-facto the punishment
might be the same as for Insolvency through Rashness
ab initio.
Punishment for Insolvency through Censure of the Law, or Loss of Character. For Insolvency through censure of the Law might either be
put upon the footing of misfortune [since the offence which drew the
censure is provided for by its proper punishment] or a coat of a
particular appearance might be adapted to the occasion. This punishment
would be more needed where the Insolvency was owing
to the loss of character brought on by some disreputable
practice not punishable by Law.
Punishment for litigious Insolvency. For Insolvency through Litigiousness or Obstinacy the Offender
ought always to be fined. This fine might generally be over
and above the necessary costs. See Tit. of Costs. Such overplus might
