Of Culpable Insolvency.
How to give a due Proportion to Confinement. If Confinement of any kind is made part of the punishment
the ne plus ultra of it should be made proportionable to the
whole amount of a man's debts: so much Confinement cancelling
so much Debt. But it should be made proportionable
also to a man's former Circumstances and rank in life; because
according to his pecuniary circumstances or connections a man
has a better or a worse excuse for borrowing, and a better or a
worse chance for paying; and because according to his circumstances
and rank in life he will suffer more or less from
the inconveniences of Confinement. A Tarif therefore or
Book of rates should be constructed [+] [+] exhibiting in as many different cases as should be thought fit to be distinguished, the proportion between debt and punishment. This book should be divided, as it were into consisting of several
chapters. Each Chapter should consist of a List of different
Sums corresponding to another of different lengths of Confinement. In each Chapter the proportion between the Debt
and the Confinement might be different; and there should
be as many Chapters as there are different conditions of
life distinguished. The number of conditions thus distinguished These conditions could not perhaps be in
a very great; , for fear of rendering the plan too intricate.
