Of Culpable Insolvency.
strange expedient for promoting industry . It is a rare case indeed if a Man
can work as well in a prison as he could at large.
At any rate that added to Military Service. If a man has a turn for industry the first use he would make
of the spare produce of it would certainly be to get rid of his badge.
If he has not a turn for industry, send him to serve the state
in a military capacity. If the rest of the soldiery would take it
amiss that he should mix with them, continue his badge, keep
him apart from the rest, and take away the distinction upon
experience of his good behaviour. For Those for whom the punishment
of the badge would not be sufficient, the punishment of
military service never could be too great.
The Punishment could never be too Severe. In cases of blame I see not how the punishment of the badge former should ever be too
severe. If it exposes a Man to disgrace it is to no more than precisely by that species and quantity of only to the disgrace
which arises out of the Offence : it punishes him no otherwise
than by making known what he has done.
In determinateness of some of the above Species how to be provided against. With regard to some of the species of culpable Insolvency
as above distinguished, it will be observed, that the fact of the delinquency
is made to consist rather in a continued habit than in a
determinate instantaneous act. Now Of such offences the idea will necessarily
