Of favouring Desertion
Penalty for not apprehending Deserters.
If Any Every one who knowing a man to be a deserter, and
having no excuse, (a) omitts doing his utmost to towards the apprehending him and bringing
him to justice, may be made to forfeit the value
of the deserter's service.
[(a) Excuses] Excuses are the same as in Art ....
Aggravation
It is matter of aggravation if the state is at it be a time of war
war.
In such case the punishment for such offence each offence of the preceding
offences shall be double.
Observations
It may sometimes be a matter of some difficulty to determine
whether the state in question be at war or
no with any other state. When war has been proclaimed
there can be no doubt. But sometimes
for various prudential reasons a state forbears or delays
proclaiming war with another state with which
however it is actually at hostilities. But a state of the
dominions of which are extensive or dispersed may
very well be at hostilities with another, and yet
the bulk of the people know nothing of the matter.
Besides, the eve of a war before the preparations for
it are compleat is a conjuncture at which a desertion
among the troops would be more sensibly felt, than
