Of favouring Desertion
Enlisting in foreign Service If any one endeavour to induce a man to
enlist himself as a soldier or a sailor in the service
of any foreign state, he shall be punished as an if he
accomplice had been assisting in desertion.
So if he endeavour to induce another
Enlisting one's self or endeavouring to induce a
man to enlist in the service of any foreign state
If the foreign state be at enmity with [the
state in question] it is Treason.

difficulty is for the state to sovereign to make proclamation
when he sees occasion establishing the extraordinary
penalty as in case of war. But this
might be giving an alarm which he would might not choose
to give. Upon the whole therefore The expediency of establishing this ground
of aggravation therefore may seems doubtful.
Observations
There are said to be some states who permit foreigners
to recruit within their dominions. These states
it should seem are not very consistent if they punish
on Suicide, or any other practises from the prevalence
of which depopulation is apprehended.
