Refusal of Truths
-fense against population, an offense against the
national wealth, an offense against the government
is an offense against r religion.
There are some circumstances which it
may be of use to bring to view, and which
relate to all trusts offices and trusts in common.

It is not often that For any of the offences which consist in
the refusal of a Trust it is
there is occasion to have recourse to punishment.
That punishment in order to be effectual, must
evidently be of the compulsive head class. Of
compulsive punishments the most obscure and most
common is simple improvement. But the
most efficacious speedy as well as certain in
its efficacy, and on that account the most
humane as well as the most forcible is that
particular afflictive mode of imprisonment which I
have stiled penitential. When it is certain that
the compliance is in a man's power, so punishment
that doubtless is not efficacious can be too severe
enough, much less too severe: for till it does produce
its effect, it is evidently not sufficient to
outweigh.
