Personal Injuries
So any person whatever may apprehend a person an offender
who is committing or attempting to committ or has committed
to any of the second rate crimes: but such criminal
although he cannot otherwise be taken may not
designedly be killed: yet in attempting to apprehend
him if it can not be done otherwise any person
may make use of may use any mortal weapon.
So if a person be violently suspected upon
probable cause of having been guilty of any first
rate or second rate crime any one without the war may upon a sincere
persuasion of his guilt founded in probable cause may [without
the warrant of a Magistrate] may apprehend him, without
the warrant of a Magistrate; although the party apprehended
turn out afterward eventually to be innocent.
If there were no cause sufficiently probable ground apparently reasonable
for the arrest although the persuasion of the party of arresting were
sincere, he may be compelled to pay mor or less
to the party arrested (if innocent) in the way of compensation. So also may he although there were no were cause officially
probable
if he much better able to bear
the damage than the party arrested according to the
direction of the Judge Court.
Arrest for Misdemeanours
There are certain cases in which offenders
who are guilty of misdemeanours only may be apprehended
without warrant. See Laws of Arrests.
Enforcing Seizure of Goods
There are also certain cases in which goods
may be seized by any one without warrant, and in which
consequently any thing may be done to the the any persons if any who opposeing
the seizure, which is necessary to overcome their
opposition. See Law of Seizures.
