Damage directly
by intentional—
obliquely-intentional

another person or upon his standing aside to avoid
being run over by a horse.

The damage to the party may be said to be directly
intentional when it is was the prospect of producing it
that appears to have been the inducement of the offender to do the
act: obliquely intentional, when it appears that though though it the damage appears
to have been was in contemplation, yet that the inducement
to the doing of the act was not the production
of such damage, but the some other event
which as it happened drew with it, and beforehand
appeared more or less likely to draw with it, [the production
of such damage as a consequence of the same
cause.

Example

Thus for if your motive for instance in striking
the man whose leg you broke was to find to break his leg, or
the pleasure of putting him to to put him to pain, and his so much pain,
or in general the doing him so much mischief
this want of his suffering such mischief
was directly intentional on your part:
but if your own the case was that you did not
care whether you put him in pain or , and
your only inducement for kicking him was to
make him clear the way, the production of
the damage was but obliquely intentional.

Personal Damage that which is directly intentional may
be either ultimately intentional or intermediately
that is subserviently intentional. It is ultimately intentional when the consideration
of the very pain produced by it is the inducement to produce it; intermediately or subserviently
intentional when this inducement to produce it is
not that very pain but some other event to the production
of
