have that or any other building for its' Town-Hall.
Another defect of the many defects in this short system
of regulations is that the not marking out precisely upon
which of the several formalities prescribed, the validity
of the licenses granted is to depend. That it should depend
upon any of them is a hardship; since they
consist of measures not in the power of those whose the persons
fate whose fate is made to depend upon them, measures
to be taken not by the Publicans themselves, but by
other persons, the Justices, at least, if not the High and Petty Constables as
and well as the Justices. But a This hardship that indeed in some
degree is unavoidable. perhaps not easily avoidable if at all unavoidable. However The
number of such formalities, ought certainly, for the reason that has been given, ought to be
precisely signified ascertained & made as small as possible. It is a satisfaction
which may be, & which therefore ought to be given to the
Publican, to know it have it in his power at one view to see all
the circumstances upon which his indemnity depends.
When conditions are annexed to the exercise of a power,
it is of importance it should be understood sufficiently explained whether in case of their not being observed it is the
person party empowerd, or the party to be benefitted by the exercise
of the power; that is to be a sufferer, or both: is the of their
not being observed; otherwise If the a party who is not meant
to be made a sufferer, is made to think he shall will be a
sufferer, an unnecessary alarm, that is, an unnecessary mis-
