-chief is created. If a party who is meant to be made a
sufferer is not made to think so, the motive necessary to
produce the mode of conduct wished for, is not created, established
at least till the Law receives an exposition by the opinion given
by a Court of Justice in punishing the some offender. The
punishment of such an offender is a mischief which if
the Law had been as explicit as it ought, to have been
would have been unnecessary.
A very proper provision regulation was that, by which disqualifies
from intermeddling in the business of granting licenses all
Magistrates that concerned of such occupations as connected them with
the class of persons to be licensed in the way
of trade. A very proper one The reason I have given in
subjoined to the Article itself [corresponding to expressive of that regulation.]
Perhaps there are is another class of persons to which it
might be extended with nearly equal propriety: viz. Persons Magistrates
happening to be interested as Landlords in any of the
houses to be licensed: unless it should be apprehended that in
small Hundreds such a disqualification might too far [not leave
qualified Magistrates in sufficient number.] too far reduce the the number.
NOTE
It might be of use also to disable persons of the above
descriptions whether Magistrates or not, from purchasing any an
licensed interest in any licensed House already licensed: also as likewise to prohibit
the licensing of any new House in which any such person
is interested as Landlord; at least to nullify all such Contracts
as leave the Tenant in any respect dependants on the Landlord. This A
dependence thus established is well known to be very general:
