and seemingly almost unlimited power of Legislation over
persons to be licensed is committed to the to Justices of the Peace. Possibly
such a power may be necessary: or to speak more strictly,
the probable utility of it may exceed the danger. Circumstances
there may arise not to be foreseen by the Legislator
that may make it necessary to limit circumscribe the liberty
of conduct of these persons in some particulars: and
these circumstances may be temporary & local: no such circumstances
seem to have ever indeed occurred to me; but I can conceive
there may be such. But if it be necessary to bestow
such a power somwhere, it seems neither necessary nor
safe to place it where it is placed at present; in the
small and perhaps confederated circle of Justices acting
for a single Hundred. The purposes It is not to be very being over
uncharitable to apprehend that thus applied bestowedlodged the purposes
it may be often be applied to may be election or other
party purposes; the Laws thus made may be levelled
at against particular obnoxious persons: they may degenerate
into privileges. [a]

A Publican for example, has in his house a particular kind of
amusement in his house not prohibited by Law: which
no one else has, & which
brings him a good deal of custom. The Publican becomes obnoxious.
The next time licensing time a condition is annexed
to all licenses in that hundred, that no such amusement shall
be kept. The Publican is by the establishment of this Law, oppressed:
