which therefore have long ago been made offences, principal
offences, as are fit to be made turned into offences introductory. This
it is to trace the torrent current of mischief from its mould, upwards
to its' source [and in order there to stomach it]
Let us return to the regulation before us. Two questions upon<add> A regulation which</add>
upon considering it the face of it it appears to be of such a nature as that it
cannot be carried executed into execution at is a dead letter. Is this
if then of such a nature? Two questions upon considering it
in this view naturally present arise themselves? 1. How is the
Brewer to know what particular quantity of Beer is necessary
to a man customer for the use only of his household?
2. Knowing that a man wants more than that the quantity ordered by a customer is more
than that quantity, how is the Brewer he to know that
it is in order designed to be retailed? 3rdly knowing that it
is designed to be retailed, how is he to know that
the Retailer has no licence? All these circumstances
it is very probable that in general the Brewer may be able to get information
about, if he desires it: but unless it can be
proved against him that he is informed of them
apparently reasonable to presume without proof that he
is informed of them, or such proof as it is thought necessary
can be obtained against him, it is in vain
to expect the Law can answer have any effect any purpose.
If no proof is made requisite The Hardship of executing in the Law will appear in flagrant be apt to appear in such a light
that no one will either in the capacity either of Informer
