Recognizance.
it should seem is not much lessen'd when they are told
that under the same penalties they must consent to
the obligation. To a man + + of plain unsophisticated understanding [whose conception of things is not
sophisticated puzzled by technical sophistry discourse], the formality obligation
of giving consent promising of taking a journey in order
to pronounce words of consent [would appear to be
but a hardship] instead of lessening the hardship would
appear to add to it: especially when for the liberty
of pronouncing these words, [a man is finds himself obliged
to pay.] he is made to pay.
To some this what has been said may appear much more than is was necessary;
But the substance of the Law is every where so thick involved
in [so thick] a veil of sophistry, that to hear it at off in any
part can not [but be a work of labour trouble.] be done without
some pains.

With respect to the Sureties it is the case is different. From
persons binding themselves as sureties an express
consent must indeed be taken: for it is only a

warrant the Law to make one man punishable for the
