New. PARISHIONERS. JUSTICES Two. Orig.SECT. III
ART.1.
In a Parish where, by virtue
of 2 or more different Acts, on the different Roads
made under those Acts, more than 3 days Statute-Duty
is performable in the whole: 2 Justices (having
summoned the Turnpike Clerks, Turnpike Surveyors & Parish
Surveyors, shall apportion such Duty amongst such
Roads & the other Highways, at discretion, regarding the
respective extents, condition & revenues.
Observations.
Suppose a part of any one of these Roads, though in the
same Parish, to be in a different county or other
Justice - District from the rest: what is to be done
then? This supposition tho' not likely to be often
realized, has nothing in it that is extravagent:
since the bounds, even of Counties, are not always the
same with those of Parishes. The uniform might be
supplied by inserting after Justices "(of each Justice County
District having where the Parish lies in more than one);
this law thought too long for a Law it may be
into separate thus.

SECT. XXVII.
Where there are 2 or more Turnpike Roads under several Acts within the same Parish, &c. and the Statute Duty exceeds 3 days,
And be it further enacted, That where there are Two
or more Turnpike Roads under several Acts of Parliament,
within the same Parish, Township, or Place, and
the Statute Duty directed by all such Acts to be taken
or applied, for the Repair of such Turnpike Roads
within such Parish, Township, or Place, shall exceed
Three Days Duty in the Whole; then, and in such
Case, it shall and may be lawful for Two or more Justices
of the Peace of the County, Riding, Division, or
Place, where such Turnpike Roads shall be, and they
are hereby required, at some Special Sessions, to adjust
and proportion such Statute Duty, betwixt such
Turnpike Roads and other highways in such Parish,
Township, or Place, in such Manner as they shall
think fit; having Regard to the Extent and Condition
of the said several Roads and Highways, and also to
the Tolls and Revenues arising from such Turnpike
Roads respectively (the said Justices previously summoning
the Clerks and Surveyors of such Turnpike Roads,
and likewise the Surveyors of the Highways for such
Parish, Township, or Place, who are hereby respectively
required to attend the Justices upon such Summons.)
