Preface
The system of silence or evasion where practicable — of false pretence
where necessary is the system dictated by over-plenitude of
power, labouring under that sort of distress which in that case situation
sets so light — distress of argument.
The privilege of silence — of silence is a privilege
which in the vailing order of things is never can not refused
to wrongdoers guilt of any description class or quality. It is the inheritance ground
and the stronghold and the invaluable privilege of malefactors: can it be defused
to Ministers. It is assessed and exercised by the meanest
wretches that grovel creep crawl under the law: can it be refused wrested from
to those who sit enthroned entrenched and above the law.
Uneasiness, the all-embracing expression under which
Locke has principle of action the spring of action in all cases has been well or
ill reduced by Locke — uneasiness, the in the side of the most
irksome of two opposite uneasinesses lots of uneasiness will in this
as in other instances the scale.
In the one scale will be the interests of the community
in respect of the option between the best-made of disparity of
convicts and the worst: with this disrepute which as it is
may be supposed to attend on a bad the wrong choice. In
the other will be the danger of giving offence to formidable persons who
require to be counted with by substituting dispatch to d
procrastination, punctuality to perfidy sincerity to treachery.
The Decision therefore depends upon the probity, the independence
the industry, the public spirit of parliamentary
men.
No violation of public faith — no violation of public duty was ever
more flagrant — never more compleatly destitute of all shadow of pretence: no
criminals, placed above law by situation, were ever more compleatly self-convicted
by necessary silence.
