Panopticon Bill 13 Settlement
13 Parish to transmitt copies
1. to Governor
2. to Sessions of the County
where the Penitentiary House
is -
Art.13. The Overseers as aforesaid on the receipt of any such examination
shall transmitt (which may be done by Post) duplicate copies (by them attested as true
ones) one to the Governor of the said Penitentiary House: the other to the General
Sessions for the County within which the said Penitentiary House shall have come to
be situated, there to be properly filed and kept as aforesaid.
14 Declaring thereupon either
1. Acquiescence under the adjudication
2. appeal -- or
3.Procedure for farther examination
Art. 14. In transmitting to the said Governor any such subsidiary examination
as aforesaid, the Overseers shall by letter (which may be by the Post as herein after
mentioned) addressed to the said Governor give notice whether they are or are not
satisfied with the Order of Adjudication before mentioned: and if not whether their intention is to appeal therefrom, or to proceed for the purpose of obtaining any farther
subsidiary examination or examinations as aforesaid and so toties quoties.
15 Appeal to be to the next sessions
of the County where the Penitentiary
House is unless put off
Art. 15. If their intention be to appeal, such appeal shall be to the
General Sessions of the County in which the Penitentiary House is situated and
shall be preferred at the next Quarter Sessions after the day by which according to
the course of the Post such notice will have been received: at which said sessions the
said appeal shall thereupon be heard, unless for want of time for the Governor to
prepare for the same or on application made on his behalf for farther time such
hearing shall be put off.
16 After further examination, appeal
to be the next sessions or next but one, unless time given by
King's Bench
Art.16. If in consequence of any such subsidiary examination as aforesaid,
such Overseers should think fit to appeal, such appeal shall be preferred either at the
next Sessions or at the next Sessions but one after the order of adjudication appealed
from shall have been received: provided that the Court of King's Bench of any
one Judge thereof may on application made on behalf of either party make any such
enlargement of the time as may appear conducive to the furtherance of Justice,
costs to be borne by the party so applying, unless in as far as shall have been otherwise ordered by the said Court.
17 Sessions to receive no evidence in
the first instance but the written
examinations
Art.17. At the time of such hearing, the several examinations taken as
above-mentioned may be produced by or on the requisition of the parties respectively
interested in their production: and the attested copies so transmitted as aforesaid shall
any one of them be admitted as good evidence, subject always to correction by the
originals if need by: and decision may thereupon be given upon such written evidence
without the examination of any person vivâ vou touching the matter of fact
then & there in question on such appeal.
