in the nature of the case it the necessary building might eventually
have come to be in readiness for it: - 3ly the Local Penitentiary
system - the plan of confining convicts of the same class,
in the Houses of Correction or other local Gaols, in the character
of a declared make-shifts, till the National Penitentiary
House should have come to be in readiness: and 4thly
and lastly the Hulk system - the plan of confining convicts of the
male sex on board the Hulks: - the choice, among these
several modes of punishment, being, under that Act, given
in every case to the judicial authority - (the several courts by
which the convicts had respectively been tried) in no case to
any such person as the Duck of Portland: for it is to another
Act - the Act of 1784 - (an Act which is not of the number
of those of which, on this occasion, it occurred to him to say
that he had "examined and understood the object of" them) it
is to this unnoticed Act (with its continuations) that he is
indebted, for all the authority he ever had, for sending transportable
convicts to the Hulks, as well as for the nearest
approach to an authority from Parliament, for keeping them
in the Gaols - for keeping them in any numbers, how small soever, or for the lengths of
time, how short soever) in the Gaols. —

In this Act of 1779, there are 74 Sections. Among these 74,
two are occupied about the transportation system: - eight and
forty - more or less, about the permanent National Penitentiary
system; ten about the temporary and local Penitentiary system;
and no fewer than one and twenty, in one way or other,
