Canal to the
Thames

And Whereas Art. 16 And whereas for the more commodious conveyance
of bulky commodities to and from the said formerly intended Penitentiary Houses
a canal was intended to be cut
from the rising ground on the premises which was being
the intended immediate site proposed for the said formerly intended same
Penitentiary Houses to the River Thames, and whereas
the expence of cutting such canal was accordingly included in the
estimate so approved as aforesaid, And Whereas in
order to effect the such communication it may would be necesary
that the present Watercourse meaning under
crossing the roa Great Road from Battersea to Wandsworth
and running under the bridge called York
Bridge should be deepened and enlarged, the same
being incapable of admitting any Barge or ordinary Boat,
Quere can
not this be done
already by agreement
with the Surveyor
of the Highway
and the City of London

Be it enacted that [+] [+] for the purpose of
effecting such communication
the said Jeremy Bentham or his Governor and his Successors
Heirs and Successors intended purchaser or his Representatives owners of the
said Estate Panopticon Hill Estate
may at any time at their own
cost expence widen and deepen as well the said watercourse as the
channel of the crick running therefrom into the said
River to wit in such manner as to enable such canal
to receive any such craft as are in used for navigating on the said
the River from Battersea Bridge upwards, and for
that purpose to pull down and rebuild the said York Bridge.

Saving [the interest
of] the Navigation &
the City's Right

Provided that the said cut be made without
sensible material prejudice to the navigation of the said River, and that
satisfaction be made to the City of London Mayor, Aldermen and Commonably touching
their rights as Conservators of the said Navigation if
the same should prove to be affected thereby, and Provided
