In both branches it has experience for
its root. It creates establishes no prohibition imposes no penalty but for the
purpose of putting a stop to some acts, mode of proceeding which
practice at present known
already by judicial experience
to be frequent & habitual and

either affords a particular means of committing depredations,
or a productive indicates its having been committed, and which
without such some penalty such prohibition can not be put a
stop to. It creates no power but what is necessary
to the giving effect to either to some such
proposed prohibition, or to some prohibition already existing
proposed or to some already existing penalty, by
bringing prohibition, by collecting the necessary evidence of the
act by which such penalty is concernedact committed in breach of it or by
seizing the person by whom it has been broken
for the purpose of rendering him amenable to
justice of obliging him in case of conviction to undergo
it
obliging him to submitt to the determination
of the law. It subjects no place to visitation,
in which for want of such visitation depredations
to an enormous amount are not habitually
and notoriously committed, depredations which such
visitation shall take place, must evidently continue
to be committed, in spite of every thing
that can be done towards the prevention of them
by prohibitions, and penalties, and powers
so long as there is a want of persons pre-disposed
and prepared to execute them.

So far as concerns the regulation it seeks
to establish, the experience it rests upon is that of
the existing evil: so far as concerns the institution
or rather the fixation and extension and
function of this official establishment, the experience
it rests upon is that of the sucessful
remedy.
