provided the consent of the City of London as
Conservators of the Navigation can be obtained to
the making that the proposed use of that at present waste unoccupied &
useless spot - if not (of which however it is supposed
there can be little doubt) then any spot in
the Land in that neighbourhood of which
a short lease can be obtained of the Proprietors & occupants (the same to be
obtained for this purpose at the expense of Mr B, and without
the a power exercise of any of the compulsive powers
of purchase provided by the existing Act.
9. By this proposed arrangement, if deemed compatible
with the existing Act of 7 July 1794 the pow
authority given by that Act may perhaps be
shewed to have been exercised and as it were expended
a upon the proposed Temporary Penitentiary
House: in that supposition, the proposed Permanent
Penitentiary House could not be proceeded upon
and established without first powers to be obtained
of Parliament for that purpose: this
forms an objection or obstacle to the arrangement,
since a fresh application to Parliament has been
already determined upon as necessary for the purpose of including
the Waste spot called Cornhill Fields
in the powers of compulsory purchase excluding
confined under that Act to London in
ownership. -- Should it be deemed necessary
to have recourse to Parliamen supposed that not even the proposed Temporary Panop Penitentiary
