§ 37
Every persons so offending shall over and above
such pecuniary forfeiture as aforesaid forfeit
And And if by force or violence any person shall endeavour
be concerned in preventing or obstructing or endeavouring to prevent or
obstruct by force or violence the execution of this Act in manner abovementioned
or otherwise then and in such case he every
or she person so offending shall every either on conviction or if
in manner as aforesaid be punished suffer as aforesaid
or if proceeded against on the found guilty on indictment may
be transported for any term not exceeding 7 years:
and in either case and it shall be lawful
for any person or
persons whatsoever
to apprehend every
person so offending
by force and violence
and either convey seize him
or her forthwith before a Justice
of the Peace or deliver
him or her into the
charge of a Constable
or other Peace-Officer
who in such case
shall take forthwith convey him or her
before a Justice of
Peace, by whom
such every such
offender shall thereupon
be dealt with
according to law.
every party person so endeavouring
with or without force to prevent or obstruct the
execution of this Act may thereupon be apprehended
by any person or persons whatsoever and by such
person or persons either carried forthwith taken in before one
Justice of the Peace or delivered into the custody
of a Constable or other Peace Officer to be by such
Peace Officer carried before a Justice of the
Peace, and by such Justice convicted dealt with according
to law.
