§ 38 continued
that upon and after any such conviction or other adjudication,
case such offender is hereinabove declared to have
it shall be lawful to such Justice, upon
incurred: Provided always that if in the case of
the party's entering into such Recognizance as aforesaid
to respite, for
such time as to
the said Justice
in his discretion
shall seem meet
either the taking
of such Distress,
or the sale thereof,
for such time as
to the said Justice
in his discretion
shall seem meet:
Provided also,
that if in the
case of
any such offense it should appear to such
Justice or Justices that the same was the result
of mistake or accident, unaccompanied by any
wilful default or negligence on the part of any
such offender, it shall be lawful to and for such Justice
or Justices to acquitt such offender or dismiss
such information or acquitt such offender altogether;
or if such offense should appear to have
been the result of negligence or culpable inattention,
but unaccompanied with any consciousness or intention
of offending, or consciousness in respect thereof
then and in such case to mitigate and reduce
any such penalty in such manner as in his to
discretion of such Justice or Justices in his or discretion their discretion shall
seem meet.
