(8) § 39.
Application of
penalties - half
to the Police Fund -
half among those
who have contributed
to the
conviction - Witness
not rendered incompetent
by expectation
of reward.
And be it further enacted that all every
forfeiture or penalty which shall be levied under
and by virtue of this Act shall be paid, if
the conviction shall have taken place any where
within the said London Police District, be paid,
according to the appointment of the said Commissioners,
either to the said Commissioners or to their Receiver,
or to the such Police Surveyor as aforesaid acting in and for such
Sub-District or place in which such conviction
shall have taken place, or if any where without
the said London Police District then and in such
case to the Police Surveyor of such Country District:
and the same when paid to shall, the as to one moiety
thereof be remitted by such Surveyor to the said
Board at such time or times and in such manner as the
amount of the said licence Duties are is herein above
directed to be remitted, and shall be applied and carried to the
and made part of the said Police Fund: and as to the other moiety, the
same shall be returned or paid over, as the case
may be, and either be applied or either to the use of the
Informer alone, or to be distributed between between or amongst the
Informer and together and such other person or persons, if any, as shall
have contributed to the conviction of the Offender
by information, search, seizure, arrest, evidence, or assistance
therein or thereunto given respectively given, or otherwise, in such pro shares
and proportions as shall in each case have been
determined by the Justice, Justices or Commissioners
as the case may be, by and before whom such Offender
shall have been convicted, subject to such general
regulations, if any, as shall from time to time have been made in
that behalf by the said Board: Provided always
that no Informer or other person shall be deemed incompetent to give evidence
touching any offense committed or supposed to be committed
