(12) §. 45 §. 43.
Board may order
prosecutions for
Perjury in committed
before itself or a Justice -

And be it further enacted, that in case of
any perjury
if in the course of any examination
taken or other evidence given on occasion in consequence on occasion of every application for any
licence or any other proceeding under and by virtue of this Act, or and or
on the occasion of any information for any offense
committed or alledged to be com have been committed
against the same against the same, or in the course of any other examination
for grounded on this Act , it shall appear to the said
Commissioners, or to any two or more Justices of the
Peace, or to any one such Justice, as the case may
be, that any wilful perjury hath by any person been committed,
it shall and may be lawful to and for
the said Commissioners of their own authority, if
such proceeding were had before them the said Commissioners,
or otherwise at the request of upon a certificate given by any such
Justice or two or more Justices as the case may
be, certifying that in the
opinion of such Justice
or Justices and that there is
reasonable cause
of pros why such
person should be
prosecuted for the
same (which said
certificate may be
according to the Form
exhibited in that Schedule
marked with [ ] to this
Act annexed)
and thereto annexed)

to order a prosecution to be instituted against
any and every such person so suspected of perjury
as aforesaid: and in case of any such Order so
made, such duty and the expense of such prosecution shall
such part thereof as would have been d
the Judge
or Judges before whom such the trial on such prosecution shall be held, shall
on the production of such Order 23 G. 2. c. 14 §. 3
"assign to the party injured,
"or other person undertaking such prosecution,
"Counsel, who shall and are hereby required to do their
"duty without any fee. "gratuity or reward for the
"same: and every such prosecution shall be carried on
"without payment of any tax or duty, and without
"payment of any fees in Court, or to any Officer of the
Court
