It is not therefore a Bill that can be offensive to any but those
whose object it is to continue those frauds which have endured long
enough and which are now meant to be suppressed for the benefit of
the Public in the easiest gentlest and mildest manner by which it is
possible for the legislature to put a Stop to such enormities.
The second Clauses of the Bill empower Justices of the peace to grant
Licenses upon the same footing as they are granted to Victuallers as
at present. This is one of the Best and principle features in the Bill
for unless Magistrates are to be allowed to exercise their usual
discretion in selecting proper objects who are worthy to be trusted
with Licences the grat purposes of the Bill would be defeated. Their
authority over the Dealers would not be felt by them and they would
degenerate into the same Class of fraudulent persons and occasion the
same enormities which are experienced at present. They are of all
others the sort of Dealers who should be under the constant Eye of the
Magistracy for on this depends the due and proper execution of the Act.
These Clauses are a further and material Check whereby the proper
conduct of these Dealers is rendered in some measure secure against
the frauds which are meant to be suppressed. They must specify and
declare their names and places of abode with the names of their
Smithies and they must also produce a certificate of their good fame
before they can even apply to the Magistrates for a Licence and further
they must enter into recognizance with one Security for their Good &
proper conduct in a Penalty of £10 and before a Licence is granted the
Magistrates must be completely satisfied that they are proper objects
to be entrusted with such License; and as a further security it is
necessary that two Police Magistrates, (who are supposed to know the
Characters of the Parties from practical information) shall always
be present while such Licenses are granted. The fourth and fifth
Clauses also establish an excellent regulation by obliging the Dealers
to paint their names upon their Doors and the Itinerant Dealers
to wear Badges and also the owners of Licenced Carts and Trucks
to paint upon them such words as shall denote what they are.
