Contains the usual Penalties and forfeitures for obstructing the
Inspector or other officers of Justice in the proper and discreet execution
of their Duty This Clause has been copied from the Police Bill which
was framed by the present Lord Chief Baron when Solicitor General in
the Year 1706 under circumstances a correct administration
of this part of the Duty of Officers of Justice had been fully considered with
a view to remedy most of the difficulties which were supposed then to
exist in this Branch of the Police System. It is a Clause merely of
form and may be modelled in various ways.

This Clause is of great importance: As no Bill perhaps
ever enacted so many provisions calculated to meet such a variety of
frauds Misdemeanours and Felonies with a view to detection Prevention
and to punishment in like manner no System of legislation in its
execution ever required so much method and energy as well as constant
and unremitting attention: and hence arises the Idea of Selecting one
Magistrate for each District/to be ascertained and assigned by his Majesty
for carrying the Act into execution. These districts will depend on
Local circumstances and the Magistrates to be chosen will of course be
those from whose real attention and activity of mind (heretofore
manifested) the most is to be expected. An Act of this sort should be
rigorously and accurately executed. If not it would be infinitely better that
it did not pass into a Law at all. It is a System which declares War against
a vast phalanx of fraudulent people some of whom are men of
considerable property. Every exertion therefore will be made to oppose
and defeat the ends of Justice and therefore it is proper and necessary
that the exigency of the case should be fairly met by the establishment of
of a firm able and responsible Executive administration that the
Public may enjoy the full benefit of a System of Legislation which
goes to the door of most of those evils from which has sprung up
those multifarious frauds and embezzlements which have by
their gradual and enormous for the last 30 Years proved
so injurious to Society.
