Chap 49. Sectn 7.
The Statute of the 28th of His present Majesty authorizing a Justice of the Peace
for two adjoining Counties to Act for either, if situate in one of them
directs the Warrant to be executed by a Peace officer in the first instance
by the Constable or Peace Officer of the County to which the same particularly
belongs as the Peace officers at Deptford in the County of Kent and the
Peace Officers of St Mary Rotherhith in the County of Surrey are generally
not to be trusted with a Warrant under the act of the 2d of his Majesty to
prevent Theft and Robbery on the River Thames. —
Submit the giving of the Magistrates of the Police authority to appoint
such of their Officers as either of them may think proper to execute such warrant
notwithstanding the said Statute of the 28th of his present Majesty
in the said Counties of Essex Middlesex and Surry — And if on such
a Warrant any raw Sugar is found in paper or other Small Bags (
(notwithstanding the Bill of Parcels that may be produced) not being in
the original Package, which may be from one notorious receiver to
another) the owner to be seized and conveyed before a Magistrate that took
the information and granted the warrant, or, other Magistrate sitting
at the Police office to be dealt with accordingly and if two or more
Dark colored Bags, that apparently have been used to convey Raw Sugar
in them - or any Bladders that have been used to Convey or draw off Foreign
Spirituous Liquors are found in their possession to be subject to punishment. It is incredible the quantity of raw Sugar that is Stolen or
unlawfully come by on board the Ships or Vessels in the Thames. We
lately had between eight and nine hundred weight of raw Sugar in Paper
Bags of 28lb weight that was seized by virtue of an information and
search warrant not far from the Office which it was judged right to
deliver up. On the Person producing two others who swore to the Sale &
delivery of the Sugar agreeable to the foresaid Statute of His present
Majesty though I had not a doubt of the whole being Stolen.
If the Dealers of Raw Sugar &c living within a certain distance a quarter
of a Mile from the Thames and of eight Miles of the City of London below
Bridge were obliged to have a Licence yearly from the Magistrates
