to fabricate false Bills of Parcels to convey [Ensure
cover?] Stores unlawfully obtained from one Dealer
to another - Vide Marine Police Bill §. 36
Annotation, "Too difficult of proof" Observation
Be the difficulty what it may I see not how
it can possibly afford as a sufficient reason
for the omission rejection of this clause; to which
at the worst the observation valeat quantum valere
potest seems as applicable as in any
case that can be mentioned. Where there is
no proof, there will be no conviction: - but is
this any reason why, where there is proof,
guilt - falsehood - forgery shall be suffered - designedly suffered to go unpunished
In the case of this as of all other species of
misconduct cases measurable might be put where
the culpable act shall have been committed, and
yet conviction be impossible. But cases in equal
number may be put where proof, and that of the most satisfactory
proof kind may be obtained: and these Mr
Colquhoun's experience has actually presented to his view: -<lb/
