5 Mr Benthams Penitentiary
Plan
5. The next and last modification of
chronical punishment which Your Committee
have to report upon is the Penitentiary
system in its second concoction latest form ,
as modified and as yet untried form, as contrived by Mr Bentham.
The Convict Colony was in the very first
years of its infancy and the circumstances prospects
which had attended opened by it the birth opening of it, scarcely as yet
risen in view, when Mr Bentham
combining in his mind consideration the acknowledged
incompetency of the Hulk system in a
moral point of view, and the repulsive unpromising
aspect of the original Penitentiary plan
in an economical point of view, came forward
with a plan Proposal by which it
appeared to him that the disadvantages of
both might be avoided and the advantages
of both obtained combined in one a superior improved degree.
Mr Bentham was already a veteran
in the field of Penitentiary speculation.
He had been in habits with Howard:
and his printed observations on the original
Penitentiary Act, before it had as yet reached
the House in attained the shape of a Bill, had been
productive of various given birth to several amendments. A first
communication of his dated so long ago as
5 Jany 1791, passed without notice: on the
17th March 1792, an amended edition of it
