As far as concerns the case of Death, the The idea of this provision was taken from the
latest Ale-house-licencing Act (32 G. 3. c. 54. §. 1)
as far as concerns the case of d but the discr
principle of the clause for a discretionary allowance
is taken singly rejecting the option of a formal
licence on th not to be taken out without taken granted but on paying
the duty afresh, which seemed an unnecessary
hardship on a family already afflicted with
the loss of its Head. As to the allowance of a
moderate time (say ( 30 days) for carrying on
the business before such allowance is obtained, it
is an indulgence from which no danger seemed
likely to come arise. It should be considered, that persons
under such affliction are not immediately
in a fit state to go about the business of solliciting
a licence, nor if they were, would it be in their
power immediately to command any such petty a meeting of Justices
Sessions. To shut up the shop &c, especially for an
uncertain time, might be productive of fatal consequence
to the trade of it: yet this must be done,
or the party must remain exposed to the penalties, if where no such
provision as the above be made is made as is here
proposed.
In the above and other Ale house licencing Acts, provision
is made for the case of a person coming it in in
the life time of the person licenced: viz upon his
which (unless in the case of his taking a partner for
which provision is already made), can only happen in
the case of the last mentioned person's quitting business. But with regard to
