By the 31 Geo. 3.c.46.§.8. Returns are required
to be made by Jailers. But this provision
though good as far as it goes, does not come up
altogether to the present purpose. It extends not to prisoners
committed on m process. The Returns it prescribes
are comp to be made at no other time than but only on the first
day of each Assizes: that is, but:nowehere more than twice in the year,
and in the same places only once. The persons They The Prisoners to becomprized
in them [+] are no other than what comprizing the but the stock existing stock of one are such only as compare the existing stock of prisoners of the above description on each
particular day. No account of intermediate commitments
or departures, between one each any such,
Assize time of returns and the preceding of another: so that
even among prisoners committed on conviction, individuals
in great numbers (by farthe greater number of
those committed for a few weeks or a few months) must
under this Act escape notice. Each Jail may have
lost nine tenths of its inhabitants several times
over by tiliners or escapes, and no indication trace of
either b misfortune be exhibited by these Returns.
No such central authority as the proposed Board
being then in existence, the persons to whom the Returns
in question are required to be made, are the Clerks
of Assize at the several Assizes. TheA Clerk of Assize
not being that sort of person who can naturally be expected to
give himself anyfeel any great concern about any such matters
the Justice on whose past any such concern the only persons relied upon for taking<add>looked to</add> in that view
have been expected must seem to have been the
several Judges of Assize: but even from these great Magistrates,
engrossed as their time is by other duties,
no very constant or systematical, attention to any
such documents, or to any ones that may be derivable
from them, canseems reasonably to be expected.
